Copyright. Unless indicated otherwise, the copyright for all content on this website is held by Aeccess GmbH (hereafter "ÆCCESS", "we", "us") or its contracting partners. Use of any content, in particular text, images and graphics, without our prior written consent is not permitted.
Disclaimer. We compile and maintain the content of this website with care. Nevertheless, we accept no responsibility or liability for the accuracy, completeness or timeliness of the information provided. Liability for any damage arising from access to, use of, or inability to use this website is excluded to the extent permitted by law. Where this website links to external sites, we accept no responsibility for their content; such sites are accessed at your own risk and the respective operator is responsible for their content.
Severability. Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions is unaffected.
Governing law and jurisdiction. These Terms of Use are governed exclusively by Swiss law. The place of jurisdiction is Zurich, Switzerland.
Privacy Policy
1. Overview. Aeccess GmbH takes the protection of your personal data seriously. This policy explains what personal data we process when you visit our website, for what purposes, and what rights you have.
2. Controller. The controller responsible for the processing of personal data described here is Aeccess GmbH, at the address stated above. For any data-protection matter, contact us at info@aeccess.com.
3. Legal basis. We process personal data in accordance with the Swiss Federal Act on Data Protection (revFADP) and, where applicable, the EU General Data Protection Regulation (GDPR). Whether and to what extent these laws apply depends on the individual case. Under the revFADP we generally do not require a specific justification to process personal data lawfully, in good faith and proportionately. Where the GDPR applies, we rely on one of the following bases: your consent (Art. 6(1)(a) GDPR), in particular for analytics and marketing cookies and for receiving our newsletter; the performance of a contract or pre-contractual measures (Art. 6(1)(b) GDPR), for example when we respond to your enquiry; compliance with a legal obligation (Art. 6(1)(c) GDPR); or our legitimate interests (Art. 6(1)(f) GDPR), in particular in the secure, stable and efficient operation of our website.
4. What personal data we process.
Server log data. When you access our website, our hosting provider automatically processes technical data that your browser transmits, including your IP address, browser type and version, operating system, the referring URL, and the date and time of access. This data is technically necessary to deliver the website and to ensure its stability and security. IP addresses are deleted or anonymised after the end of use.
Contact data. If you contact us via the contact form, by email or by telephone, we process the data you provide (such as your name, organisation, email address and the content of your message) for the sole purpose of handling your enquiry and any resulting business relationship.
Newsletter data. If you subscribe to our newsletter, we process the email address you provide, and any name you give, in order to send you the newsletter.
5. Hosting. Our website is operated on the platform of Squarespace Inc., 225 Varick Street, 12th Floor, New York, NY 10014, USA. Squarespace processes the server log data described above on our behalf as our processor, and data may be transferred to and processed in the United States. Necessary cookies, set by our platform (Squarespace) by default, which are required for the basic functioning, security and delivery of the website.
Analytics and marketing cookies, which are described in section 7 and are only set where you have consented via our cookie banner.
You can manage or refuse cookies at any time through our cookie banner and through your browser settings. Disabling necessary cookies may impair the functionality of the website.
7. Analytics and third-party services. To understand and improve how our website is used, and to measure our advertising, we use the following services. Where these set non-essential cookies, they are activated only after your consent.
Squarespace Analytics. Provided by Squarespace Inc. as part of our website platform. It collects aggregated usage information, such as page views and visitor numbers, to help us understand website performance. Further information: https://www.squarespace.com/privacy
Google Analytics. A web analytics service provided by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (for users in Switzerland and the EEA), and Google LLC (USA). Google Analytics uses cookies to analyse website use. We have configured the service so that your IP address is truncated within Europe before any transfer. The information generated is transmitted to and stored by Google, including in the United States, and used to compile reports on website activity for us. Google Ads. We use Google Ads, an online advertising service provided by Google Ireland Ltd. (for users in Switzerland and the EEA) and Google LLC (USA), to measure the effectiveness of our advertising and to display relevant ads. When you reach our website via a Google ad, a cookie is set that allows us and Google to recognise that a user clicked on the ad and was directed to our website (conversion tracking). These cookies have a limited lifespan and are not used to identify you personally. Data may be transferred to and processed by Google, including in the United States. LinkedIn. We use the LinkedIn Insight Tag provided by LinkedIn Ireland Unlimited Company, Wilton Plaza, Dublin 2, Ireland (for users in Switzerland and the EEA), and LinkedIn Corporation (USA). It allows us to measure the effectiveness of our presence and any advertising, and to understand interactions with our website. Data may be processed by LinkedIn, including in the United States, and, where you hold a LinkedIn account, associated with your profile in accordance with LinkedIn's policy. 8. Newsletter. If you subscribe to our newsletter, we process the email address you provide, and any name you give, in order to send you information about ÆCCESS, our work and our offerings. This processing is based on your consent (Art. 6(1)(a) GDPR). You can unsubscribe at any time with effect for the future, via the unsubscribe link in every newsletter or by emailing info@aeccess.com. Withdrawing your consent does not affect the lawfulness of processing carried out before the withdrawal.
9. Disclosure to third parties. We disclose personal data to third parties only where permitted and appropriate, in particular to the service providers named above (acting as our processors), and to authorities, advisers or auditors where legally required or necessary. We do not sell your personal data.
10. Transfers abroad. Some of the providers named above process data outside Switzerland or the EEA, in particular in the United States. Where a recipient is located in a country without an adequate level of data protection, we rely on appropriate safeguards, in particular the European Commission's standard contractual clauses (https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj), or on another legal exemption such as your consent or the necessity of the transfer for the performance of a contract.
11. Retention. We process and store personal data only for as long as necessary for the purposes described, or as required by applicable law, after which it is anonymised or deleted. Server log data is stored for a limited period only. Contact data is retained for as long as needed to handle your enquiry and any resulting relationship. Newsletter data is processed until you unsubscribe.
12. Your rights. Subject to applicable law, you have the right to request information about the personal data we hold about you (Art. 15 GDPR; Art. 25 revFADP), and to request its correction (Art. 16 GDPR; Art. 32 revFADP), deletion (Art. 17 GDPR), restriction (Art. 18 GDPR), or portability (Art. 20 GDPR; Art. 28 revFADP). Where processing is based on consent, you may withdraw it at any time with effect for the future. Where processing is based on legitimate interests, you may object to it (Art. 21 GDPR). You also have the right to lodge a complaint with the competent supervisory authority, in Switzerland the Federal Data Protection and Information Commissioner (FDPIC, https://www.edoeb.admin.ch).
13. Links to other websites. Our website may link to sites we do not operate and which are not covered by this policy. We have no influence over their data processing, and the respective operator is responsible for their content and privacy practices.
14. Data security. We take appropriate technical and organisational measures to protect your personal data against unauthorised access, loss or misuse. Please note that data transmission over the internet cannot be guaranteed to be fully secure.
15. Changes. We may amend this policy at any time to reflect changes in our practices or legal requirements. The version published on this website applies.
